Notwithstanding the foregoing, if any vehicle described in section H1.1 (Notification and Payment if Disposal) is sold, leased or otherwise disposed of during the 12-year period for conventional vehicles or a 5-year period for a specialized vehicle, and replaced to meet technical or operational requirements of the Recipient with a vehicle of equal or greater value, the Recipient may, in lieu of the repayment set out in section H1.1 (Notification and Payment if Disposal) and with the Province’s prior written consent, reinvest the proceeds from the disposal into the replacement vehicle.

Vehicle Replacement. In the event that any vehicle included on the Vehicle Inventory reaches the end of its useful life, RFTA shall either: (1) sell the vehicle by means of an advertised sealed bid and remit any proceeds of the sale to the BOCC; or (2) convey title to the vehicle to the BOCC by written agreement, at which time the vehicle shall be removed from the Vehicle Inventory. The Parties recognize the disposition of any vehicle must be in accordance with the rights of lien holders identified on the vehicle title.
