Common use of Variation Order Clause in Contracts

Variation Order. Whether or not the Contract Administrator has issued a "Variation Price Request" under clause 10.1, the Contract Administrator may direct the Contractor to carry out a Variation by a written document titled "Variation Order", in which the Contract Administrator will state one of the following: the proposed adjustment to the Contract Price as set out in the Contractor's notice under clause 10.1 (if any) is agreed and the Contract Price will be adjusted accordingly; or any adjustment to the Contract Price will be determined under clauses 10.3(a) and 10.3(b). No Variation will invalidate the Contract irrespective of the nature, extent or value of the services the subject of the Variation. Subject to clauses 8.4, 8.5, 10.4 and 12.3, the Contract Price will be adjusted for the value of all Variations carried out by the Contractor by: if there is a Table of Variation Rates and Prices, an amount determined by using any rates or prices in this which may be applicable to the Variation; or a reasonable amount to be agreed between the parties or, in default of such agreement, determined by the Contract Administrator. In either case the value of the Variation must include any extra reasonable costs which will be incurred by the Contractor as a direct result of the Variation delaying the Contractor achieving Completion by the Date for Completion.
