Variable Operating Costs. If during any year the entire Building is not occupied or Landlord is not furnishing utilities or services to all of the premises in the Building, then the Variable Operating Costs for such year shall be “grossed up” (using reasonable projections and assumptions) to the amounts that would apply if 95% of the Building were occupied and all of the premises in the Building were provided with the applicable utilities or services. Variable Operating Costs are Operating Costs that are variable with the level of occupancy of the Building (such as janitorial services, utilities, refuse and waste disposal, and management fees).
Variable Operating Costs. Variable Operating Costs for the Aircraft are allocable to the Owner that has scheduled the Flight Hours resulting in such costs and expenses and shall include, but are not limited to, the following: (i) Aircraft fuel, oil, and taxes related thereto; (ii) catering and other passenger services and expenses; (iii) Aircraft landing and parking fees, overnight fees; (iv) federal excise taxes, if any; (v) overflight, enroute or air-traffic control user fees, if any; (vi) flight crew per-diem including but not limited to expenses of crew on overnight trips (i.e., cost of hotel rooms, stipend for meals, etc.); (vii) post-flight cleaning of Aircraft interior; (viii) ground handling fees; (ix) actual charges imposed on flights outside of the United States including but not limited to landing, flight management and flight planning fees; (x) all costs for additional crew necessary to perform the flights outside of the United States in compliance with FARs; (xi) actual charges for in-flight telephone use; and (xii) actual charges for Aircraft de-icing services.
Variable Operating Costs. Notwithstanding any contrary language in this Article 5, if less than ninety-five percent (95%) of the rentable area of the Project is occupied at all times during any calendar year pursuant to leases under which the terms have commenced for such calendar year, Landlord will reasonably and equitably adjust its computation of Operating Costs for that calendar year to obligate Tenant to pay all components of Operating Costs that vary based on occupancy in an amount equal to the amount Tenant would have paid for such components of Operating Costs had ninety-five percent (95%) of the rentable area of the Project been occupied at all times during such calendar year pursuant to leases under which the terms have commenced for such calendar year. Landlord will also equitably adjust Operating Costs to account for any Operating Costs any tenant of the Building pays directly to a service provider.
Variable Operating Costs. For the Base Year and any later calendar year or partial calendar year in which less than ninety-five percent (95%) of the rentable area of the Building is occupied by tenants or in which Landlord is providing services to less than ninety-five percent (95%) of the rentable area of the Building, Variable Operating Costs for such period shall be increased to the amount which would have been incurred had ninety-five percent (95%) of the rentable area of the Building been occupied or had Landlord been providing services to ninety-five percent (95%) of the rentable area of the Building. “Variable Operating Costs” means any costs and expenses included in the definition of Operating Costs, the amount of which varies with the level of occupancy in the Building.
