Common use of Variable O&M Payments Clause in Contracts

Variable O&M Payments. The Variable O&M Payment (“VOMP”) for each monthly billing period equals the Variable O&M Rate multiplied by the sum over such month of 1) the Unadjusted Metered Energy generated in response to a Buyer dispatch instruction relative to a Reservation of the Unit and 2) , during those hours when Buyer has scheduled a Physical Energy Schedule from the Unit pursuant to Section 3.2, the lesser of in each hour: (i) the Unadjusted Metered Energy (in MWh), or (ii) the Final Physical Energy Schedule (in MWh). The Variable O&M Rate for the term of the Agreement is $7.00 / MWh.
