Common use of Valid Claim Clause in Contracts

Valid Claim. A claim of a patent or patent application that has not expired or been held invalid or unenforceable by a court of competent jurisdiction in a final and non-appealable judgment.

Valid Claim. A claim of an issued patent which claim has not lapsed, been canceled or become abandoned and has not been declared invalid by an unreversed and unappealable decision or judgment of a patent court or patent application other appropriate body of competent jurisdiction, and that has not expired or been held admitted to be invalid or unenforceable by a court of competent jurisdiction in a final and non-appealable judgmentthrough reissue or disclaimer.

Valid Claim. A claim of a from any issued patent or patent application that which has not expired been revoked or been held invalid or unenforceable by a decision of a court or other government agency of competent jurisdiction in a final and non-appealable judgmentjurisdiction, which decision is unappealable or unappealed within the time allowed for appeal.

Valid Claim.
