Common use of Used Material Clause in Contracts

Used Material. (a) Material which is in sound and serviceable condition and is suitable for reuse without reconditioning shall be priced at seventy-five percent (75%) of the current market value of new Material. (b) Material which, after being reconditioned, will be further serviceable for its original function shall be priced at fifty percent (50%) of the current value of new Material. (c) Used Material which cannot be classified as (a) or (b) above shall be priced by the Parties through discussions at a value commensurate with its use. (d) If the Operator wishes to use a method other than the above for pricing used Material, such other method shall be agreed upon in advance by the Parties through consultations.
