Use of Your Data. We collect, process and hold personal information in order to provide you with an appropriate level of personal care. In signing this contract you agree to the collection and holding of this information in accordance with all applicable Data Protection laws and give your permission for us to use photographs for the purposes of inclusion in documents including, but not limited to, Care Plans, medical administration records, room identification and our personal folders relating to you.
Use of Your Data. Data Protection and Confidentiality
32.1 When you apply for an account or other services with us, we use your personal information to verify your identity, open that account, provide those services and for other purposes set out in our privacy notice, which is available at ▇▇▇▇://▇▇▇.▇▇▇▇- ▇▇▇.▇▇▇/▇▇▇▇▇▇▇/▇▇▇▇▇%▇▇▇▇/▇▇▇▇▇▇%▇▇▇▇▇▇▇▇▇▇/. The privacy notice describes why we use personal information and how we comply with applicable data protection laws (including the legal bases for our processing of personal information), who we share personal information with, where we transfer personal information, and your data protection rights. You acknowledge that you have read and understood the information in the privacy notice.
32.2 You agree that we may disclose the personal information we hold about you for the following purposes (we seek this agreement from you for the purposes of confidentiality and other rules and laws, but not for the purposes of the EU’s General Data Protection Regulation (2016/679) or similar data protection laws in the EEA or former member states of the EU):
(a) to third parties and members of the ICBC Group in connection with the provision of accounts, products and services to you;
(b) to members of the ICBC Group for the purpose of providing us with various IT and other administration services supporting our business and, where appropriate, to fraud prevention, law enforcement and credit reference agencies, to prevent crime, verify your identity and recover debt;
(c) where we, or third parties or members of the ICBC Group processing personal information on our behalf, are required to do so by law, regulation or legal proceedings;
(d) where we, or other members of the ICBC Group, are required by legislation or by agreement with tax authorities to report certain information about you and your relationship with us, including information about your accounts to the tax authorities in the UK or directly to the tax authorities in other countries (such as the USA); where there is a change (or prospective change) in the ownership of any ICBC Group company or their respective businesses, to the new or prospective owners;
(e) where we are seeking to recover sums owed to us or members of the ICBC Group;
(f) where our legitimate interests require such disclosure; and
(g) where you have otherwise consented to the disclosure.
Use of Your Data. 41.1 We will take appropriate steps to ensure that any collection, use, storage, disclosure, or any other processing of Your Data which is performed by us or on our behalf is at all times performed in accordance with applicable Data Protection Law.
41.2 Except as set out in the other provisions of paragraphs 40 (Confidentiality of Your Data) and 41 (Use of Your Data), we will not use Your Data for any purpose which is not necessary for us to perform the Services in accordance with this Agreement and Applicable Law.
41.3 You agree that, regardless of the provisions in paragraph 41.2, we may use Your Data for the purposes of:
(A) administering your account, handling any complaint you may have, improving the Services and our internal processes, developing new products and Services, and other purposes connected to the performance of the Services;
(B) compliance with legal or regulatory obligations and risk-management;
(C) marketing products, Services, and opportunities offered by us and other members of the Deutsche Bank Group which may be of interest or benefit to you, always taking into account any marketing preferences you indicate to us; and
(D) performing any statistical or other analysis, and using the result of such analysis for our own business purposes (which may be completely unrelated to the provision of the Services), provided that the result of such analysis is aggregated with other data and anonymised.
41.4 In addition to any other consents given generally in respect to our services, you hereby explicitly consent to our accessing, processing and retaining Your Data for the purposes of providing our payment services to you as set out in Part Banking and Deposit Terms. If you withdraw this consent to our using Your Data then we will stop providing payment services, but may still use Your Data where we have lawful grounds to do so (for example because we need to retain records for regulatory purposes).
41.5 Owing to the global nature of Deutsche Bank Group's business operation and the financial markets in which we operate, our Authorised Recipients and other third parties with whom we share Your Data (see paragraph 40.4 above) could be located anywhere in the world, including the USA and other countries outside the EEA, where the local Data Protection Law may not offer legal protection that is equivalent to that which is offered under the UK's Data Protection Law. You acknowledge and agree that we may allow Your Data to be transferred to or accessed...
Use of Your Data. You explicitly consent to us accessing, processing, and retaining any information you provide to us, for the purposes of providing payment services to you. This does not affect any rights and obligations you or we have under data protection legislation. You may withdraw this consent by closing your account. If you do this, we will stop using your data for this purpose, but may continue to process your data for other purposes.
Use of Your Data. Please read carefully the separate ‘Using your personal information’ leaflet. This explains how we use any information you provide us. You explicitly consent to us accessing, processing, and retaining any information you provide to us, for the purposes of providing payment services to you. This does not affect any rights and obligations you or we have under data protection legislation. You may withdraw this consent by closing your account. If you do this, we’ll stop using your data for this purpose, but may continue to process your data for other purposes.
Use of Your Data. The Software has the capability to capture certain ▇▇▇▇▇▇▇▇'s personally identifiable information and transfer such information to VTEX. VTEX may use such information in connection with VTEX Software and Support Services. In addition, VTEX may aggregate and anonymize such personal information, in accordance with applicable law, and use such resulting de-identified data set for VTEX’s business purposes. By contracting, downloading, installing, copying, or otherwise using the Software, you agree to such transmission and use. Licensee agrees VTEX may share Licensee’s personal data to thirty-party services providers, such as Pardot and Unbound, in order to keep Licensee informed about updates on Software and to provide Support Services. Use of Your Data. We may contact Users directly through in-app notifications in order to provide them with services such as notifying that a document has been shared with them. We use your User Data and any Personal Information you provide for our business purposes and in a manner consistent with this Policy. This information includes without limitation, technical information relating to your device, system and Your Account, that is gathered periodically to:
(a) facilitate the provision of software updates, product support, marketing efforts and other services and communications to you related to Pigeonhole, including providing you with information about services, features, surveys, newsletters, offers, promotions;
(b) provide other news or information about us and our select partners; and
(c) send you technical notices, updates, security alerts and support and administrative messages. If you provide Personal Information for a particular reason, that Personal Information will only be used in connection with the reason for which it was provided or for a related purpose.
Use of Your Data. FACS shall not use or distribute Your Data to any third party without your prior written consent other than a) to FACS’s subcontractors who are bound by a similar duty of confidentiality as that contained herein and b) in conjunction with providing the Service to You. Notwithstanding the foregoing, in consideration of FACS’s performance of its obligations under this Agreement, FACS shall have a non-exclusive, worldwide, royalty free, unrestricted, perpetual license and right to use, distribute, market, sell, create derivative works of and display any of Your Data that has been De-Identified on a stand-alone basis or as aggregated or decompiled, including without limitation information, analyses, statistics, metrics, benchmarks, and other data entered into or generated by the Service (or derived from Your or a User’s use of the Service). Unless You provide written notice to FACS pursuant to Section CONTACT INFORMATION, You also grant FACS these rights for Identified data. If you subsequently grant FACS these rights for Identified Data, you agree that such rights are retroactive to the date of Your acceptance of this Agreement.
Use of Your Data. You shall own and retain all right, title and interest in and to Your Data. Vercel may use and disclose Your Data solely to the extent necessary to provide the Services to you and for security to protect the Services and third parties from fraud, illegal activities, malware, malicious files or content, viruses and the like and for no other purpose. Otherwise, Vercel will not sell, disclose, or share any Your Data (or any part or product thereof) with anyone else. Vercel will implement and maintain reasonable information security policies and processes (including technical, administrative and physical safeguards) that are designed to prevent unauthorized access to or use or disclosure of the Services or any Your Data.
