USE AND BUILDING RESTRICTIONS. The Developer covenants and agrees with the Trust Committee that, in perpetuity: (a) no building or structure may be constructed on the Project Lands, other than the Affordable Housing Units; (b) no building or structure may be constructed on the Project Lands except in accordance with the guidelines prescribed in the Salt Spring Island Official Community Plan Development Permit Area 1, any building permit issued by the Capital Regional District and any other agreement entered into between the Developer and the Trust Committee; and (c) the Developer must at all times ensure that the Project Lands are owned, used and occupied in compliance with all statutes, laws, regulations, and orders of any authority having jurisdiction.
