Common use of Upon Early Settlement of Purchase Contracts by a Holder of the related Units Clause in Contracts

Upon Early Settlement of Purchase Contracts by a Holder of the related Units. the Company shall issue, and the Holder shall be entitled to receive, 3.0084 shares of Common Stock, subject to adjustment in the same manner and at the same time as the Settlement Rate is adjusted pursuant to Section 5.5, on account of each Purchase Contract as to which Early Settlement is effected (the “Early Settlement Rate”).

Upon Early Settlement of Purchase Contracts by a Holder of the related Units. the Company shall issue, and the Holder shall be entitled to receive, 3.0084 0.8791 shares of Common Stock, subject Stock on account of each Purchase Contract as to adjustment which Early Settlement is effected (the "EARLY SETTLEMENT RATE"). The Early Settlement Rate shall be adjusted in the same manner and at the same time as the Settlement Rate is adjusted pursuant to Section 5.5, on account of each Purchase Contract as to which Early Settlement is effected (the “Early Settlement Rate”)5.04.
