Unsafe Assignment Sample Clauses
The Unsafe Assignment clause defines restrictions or conditions under which certain tasks or responsibilities may not be assigned if they are deemed hazardous or present unacceptable risks. In practice, this clause may prevent an employer from assigning work that exposes employees to unsafe environments, or it may require specific safety measures to be in place before such assignments are made. Its core function is to protect parties from being compelled to undertake dangerous work, thereby allocating risk and ensuring workplace safety.
Unsafe Assignment. The union and employer recognize the critical lack of Personal Protective Equipment (PPE) and the resulting variation from historic best practices that have been allowed by Oregon Health Authority and CDC. However, caregiver safety is of paramount importance to ensure continued delivery of patient care to the greatest number of patients. Therefore, any nurse who believes that the PPE and other precautions that are being provided are not in compliance with OHA guidelines shall follow the following chain of command:
1) All nurses should be familiar with current OHA guidelines relating to PPE and COVID-19 precautions,
2) Before taking an assignment, the nurse should determine whether adequate PPE is available for the patient being assigned. If the patient is a diagnosed COVID-19 patient or person under investigation (PUI) and the nurses believe that the assignment is unsafe to themselves because of lack of PPE, based on OHA guidelines, the nurse should identify the issue with their charge nurse.
3) If charge nurse cannot correct the issue, and the nurse wishes to decline the assignment, then they should do so by identifying the deficiency to the nurse’s supervisor by reference to OHA guidelines.
4) If they are ordered to accept the assignment by a supervisor, and the nurse again wishes to decline, the nurse should identify the non-compliance with OHA guidelines to the CNO or their designee at the following phone number and submit an SRDF form to the Union and employer.
5) If the CNO/designee still directs the nurse to accept the assignment, and the nurse refuses, the nurse shall be placed on leave. No nurse who in good faith refuses a patient assignment based upon non-compliance with OHA PPE guidelines shall be disciplined.
Unsafe Assignment. The Association and SHS recognize caregiver safety are of paramount importance to ensure continued delivery of patient care. Any nurse who believes that the PPE and other precautions are non-compliant with SHS Policy, OHA, and CDC guidelines shall use the following chain of command:
a. All members should be familiar with guidelines relating to PPE and COVID-19 precautions.
b. If the member believes that the assignment is unsafe to themselves because of lack of PPE, the member should identify the issue with their charge nurse (or immediate supervisor).
c. If the charge nurse cannot correct the issue, and the member wishes to decline the assignment, then the member should identify the deficiency to the nursing supervisor.
d. If the member is ordered to accept the assignment by the nursing supervisor, and the member declines, the member should identify the non-compliance to the Vice President of Patient Services (VPPS) or their designee and submit a Staffing Request and Documentation Form to the appropriate individuals.
e. If the VPPS or designee directs the member to accept the assignment, and the member refuses, the member shall be placed on paid leave. No member, who in good faith refuses a patient assignment based upon lack of proper PPE or other precautions, shall be disciplined.

25 a. All members should be familiar with guidelines relating to PPE and COVID-19 precautions.
26 b. If the member believes that the assignment is unsafe to themselves because of lack of PPE as 27 outlined in section 4 of this agreement, the member should identify the issue with their charge 28 nurse (or immediate supervisor).
29 c. If the charge nurse cannot correct the issue, and the member wishes to decline the assignment, 30 then the member should identify the deficiency to the nursing supervisor.
31 a. If the member is ordered to accept the assignment by the nursing supervisor, andthe 32 member declines, the member should identify the non-compliance to the VicePresident 33 of Patient Care Services (VPPCS) or their designee and submit a Staffing Requestand 34 Documentation Form to the appropriate individuals.
