Unique Services. Funding shall be adjusted for any unique services provided by the District to a Network School pursuant to written agreement of the Parties. Such unique services may include those outlined in the Facilities Use Agreement, referenced in Section 15.A.d, which shall be applicable should the School occupy a District owned facility.
Unique Services. Employee hereby represents and agrees that the services to be performed under the terms of this Agreement are of a special, unique, unusual, extraordinary, and intellectual character that gives them a peculiar value, the loss of which cannot be reasonably or adequately compensated in damages in any action at law. Employee, therefore, expressly agrees that the Company, in addition to any rights or remedies that the Company might posses, shall be entitled to injunctive and other equitable relief to prevent or remedy a breach of this Agreement by Employee.
Unique Services. Writer acknowledges that the services to be rendered by Writer hereunder are of a special, unique, unusual, extraordinary and intellectual character which gives them a peculiar value, the loss of which cannot be reasonable or adequately compensated in damages in an action at law, and that a breach by Writer of any of the provisions of this Agreement will cause Publisher great and irreparable injury and damage. Writer expressly agrees that Publisher shall be entitled to the remedies of injunction and other equitable relief to enforce this Agreement or to prevent a breach of this Agreement or any provision hereof, which relief shall be in addition to any other remedies, for damages or otherwise, which may be available to Publisher.
Unique Services. Employee acknowledges and agrees that the services rendered to Sebring and the Affiliates are of a special, extraordinary character with a unique value to Sebring and its Affiliates, the loss of which cannot adequately be compensated by damages in an action at law.
Unique Services. Notwithstanding anything to the contrary in Paragraph 24., above, you acknowledge that the services to be rendered by you under the terms of this Agreement, and the rights and privileges granted to Studio by you under its terms, are of a special, unique, extraordinary and intellectual character, which gives them a peculiar value, the loss of which cannot reasonably or adequately be compensated in damages in any action at law, and that a breach by you of any of the provisions contained in this Agreement may cause Studio great and irreparable injury and damage. Notwithstanding anything to the contrary in Paragraph 24., above, you acknowledge that Studio shall be entitled, in addition to any other remedies it may have at law, to seek the remedies of injunction, and other equitable relief for a breach of this Agreement by you. This provision shall not, however, be construed as a waiver of any of the rights which Studio and/or you may have for damages or otherwise.
Unique Services. 19.1 The services to be provided by the Artist and the rights granted by the Artist pursuant to this Agreement are of a special nature which gives them particular value, the loss of which may not be reasonably or adequately compensated for in damages in an action at law, and the breach by the Artist of the provisions of this Agreement may cause the Producer irreparable injury and damage for which the Producer will be entitled to seek and obtain injunctive or other equitable relief. The granting of any equitable relief will not be construed as a waiver of any other rights of the Producer in law or equity.
Unique Services. Executive recognizes that the services to be rendered by him pursuant to this Agreement are of a character giving them peculiar value, the loss of which cannot be adequately compensated for in damages, and in the event of a breach of this Agreement by Executive, the Company shall be entitled to equitable relief by way of injunction in addition to any other legal or equitable remedies available to it.
Unique Services. You expressly acknowledge that your services hereunder are of a special, unique, intellectual, and extraordinary character which gives them peculiar value, and that, in the event of a breach by you of any term hereof, we will be caused irreparable injury which cannot adequately be compensated by money damages. Accordingly, we shall be entitled to injunctive relief, in addition to any other rights or remedies which we may have, to enforce the terms of this Contract.
Unique Services. You acknowledge and represent that the Service under this Agreement is not a regular telecommunication service. Substantial differences exist between regular telecommunication services and the Services offered by VoIP and therefore the latter is subject to different regulatory treatment than the regular telecommunication service which may limit or affect your rights of redressal before the relevant Federal and State Telecommunication Regulatory Agencies and/or judicial forums. VoIP shall make all efforts to minimize disruptions to your use and access of the Service but the same is likely to be affected by events beyond our control like power outages, fluctuations in the internet, your underlying ISP or broadband service, or maintenance.
Unique Services. 16.01 You expressly acknowledge that your and the Artist's services hereunder are of a special, unique, intellectual, and extraordinary character which gives them peculiar value, and that in the event of a breach by you or the Artist of any term hereof, Company will be caused irreparable injury which cannot adequately be compensated by money damages. Accordingly, Company shall be entitled to seek injunctive relief, in addition to any other rights or remedies which Company may have, to enforce the terms of this Agreement.
