UNION PLAN. 7.6 ARTICLE II.
UNION PLAN. SNFCo shall assume Scout's obligations and liabilities ---------- under collective bargaining agreements: (a) between Scout and the Service Employees International Union dated November 6, 1995, (b) between Scout and the Service Employees International Union, Local 150, AFL-CIO-CLC, dated November 1, 1995, (c) between Scout and the Healthcare Workers' Union, ▇▇▇▇▇ ▇▇▇, ▇▇▇▇, ▇▇▇- CIO, dated October 1, 1994 and (d) between Scout and the Nursing and Convalensecent Home Employees Division of ▇▇▇▇▇ ▇▇, ▇▇▇▇, ▇▇▇-▇▇▇, dated May 1, 1995, including Scout's obligation to contribute to the SEIU National Industry Pension Fund (the "Union Plan"). SNFCo shall assume and discharge any liability pursuant to ERISA Section 4203 and 4205 with respect to the Union Plan which may arise by reason of the Distribution (as defined in the Distribution Agreement).
UNION PLAN. As of the Effective Date, the Company shall continue ---------- to sponsor and maintain the Precision Scientific Instruments and Precision Scientific Petroleum Instruments Defined Benefit Pension Plan (the "Union Plan"). The Seller shall make all contributions to the Union Plan that are required to be made (whether by applicable law or by the terms of the Plan) prior to the Effective Date, and the Seller shall be liable for no further contributions to the Union Plan after such payments have been made. As soon as practical after the Effective Date, but no more than 60 days thereafter, the Buyer shall direct the Seller and the Seller shall transfer all Union Plan assets and liabilities from the Varlen Corporation Defined Benefit Master Trust ("Varlen Master Trust") to an employee benefit trust to be established and maintained by the Company. If there is any delay in the transfer of Union Plan assets and liabilities beyond the 60-day period referred to above that is caused by Buyer or its agents and administrators with respect to the transfer of Union Plan assets from the Varlen Master Trust, Buyer shall reimburse Seller for all costs and expenses associated with the Company's delayed withdrawal from the Varlen Master Trust. If any dispute arises between the Seller and the Buyer concerning the amount or nature of the Varlen Master Trust assets which are attributable to the Union Plan, the matter shall be resolved by a public accounting firm mutually selected by the Seller and Buyer.
UNION PLAN. 4.01 For the purposes of bargaining and the application of this Collective Agreement, the Polytechnique recognizes the Public Service Alliance of Canada as the only official representative and bargaining agent for the postdoctoral fellows covered by the certificate of accreditation issued by the Ministry of Labour and any amendment thereto. 4.02 All postdoctoral fellows who, as of the date of signing of the Collective Agreement, are members of the Union or subsequently join the Union, shall remain members for the term of this Collective Agreement, subject to the provisions of the Labour Code. The Union shall have them sign a membership card. 4.03 Each pay period, the Polytechnique shall deduct from the salary of each postdoctoral fellow an amount equal to the regular and/or special dues set by the Union. 4.04 For the purposes of clause 4.03, these deductions shall be made no more than thirty

The Union shall have them sign a membership card. 4.03 Each pay period, the Polytechnique shall deduct from the salary of each postdoctoral fellow an amount equal to the regular and/or special dues set by the Union. 4.04 For the purposes of clause 4.03, these deductions shall be made no more than thirty (30) days after receipt of the notice to this effect, which shall include the amount or the contribution rate. 4.05 The Union shall forward to the Polytechnique a copy of any resolutions adopted by the Annual General Membership Meeting with respect to regular or special Union dues, and a copy of the by-laws. 4.06 The Polytechnique shall provide the Union with a monthly electronic list of the name and deduction amount of each postdoctoral fellow from whom union dues have been deducted. 4.07 In the event of any administrative or technical miscalculation or omission in the deduction of union dues, the Polytechnique agrees, upon written notice from the Union to this effect, to collect the non-remitted amount. 4.08 Any administrative correspondence concerning these deductions shall be between the Polytechnique and the Public Service Alliance of Canada, with a copy to the Union.
UNION PLAN. Union membership 5.01 As of the effective date of the Collective Agreement, all employees must join the Union and remain members for the term of this Agreement, subject to the provisions of the Labour Code. 5.02 The Employer shall not be required to dismiss any employee whose membership has been rejected or deferred by the Union, or whom it has suspended or expelled. 5.03 The Employer undertakes to give each newly hired employee a membership form provided by the Union, and to refer the employee to the website on which the Collective Agreement is posted. 5.04 As of the date of signing of this collective agreement, the Employer shall provide the Union with twenty (20) hard copies of the Collective Agreement.
