Common use of Uniform Commercial Code Remedies Clause in Contracts

Uniform Commercial Code Remedies. Beneficiary shall have all of the rights, remedies and recourses with respect to the Personalty and the Fixtures afforded to it by the Applicable UCC, including, without limitation, (i) the right to conduct a unified sale of such Personalty and Fixtures in connection with a judicial or power of sale foreclosure of any portion of the Trust Property that constitutes real property, (ii) any the right to take possession of the Personalty and the Fixtures or any part thereof, and (iii) to take such other measures as Beneficiary may deem necessary for the care, protection and preservation of the Personalty and the Fixtures, in addition to, and not in limitation of, the other rights, remedies and recourses afforded by this Deed of Trust and the other Loan Documents.
