Common use of UNEs Clause in Contracts

UNEs. As conditions to accessing and using any UNE (whether on a stand-alone basis or in combination with other UNEs, with a network element possessed by CLEC, or pursuant to Commingling), CLEC must be a Telecommunications Carrier (Section 251(c)(3)), and must use the 251(c)(3) UNE(s) for the provision of a Telecommunications Service (Section 251(c)(3)) as permitted by the FCC. Together, these conditions are the “Statutory Conditions” for access to 251(c)(3) UNEs. CLEC hereby represents and warrants that it is a Telecommunications Carrier and that it will notify AT&T immediately in writing if it ceases to be a Telecommunications Carrier. Failure to so notify AT&T shall constitute material breach of this Agreement.
