Nothing contained in this Agreement or any document delivered herewith shall require or imply that the Subscriber is or be an Underwriter as defined in the 1933 Act of 1934 Act, nor a "statutory underwriter." The Subscriber shall not be required to take any action or assume any liability or obligation which would or could impose Underwriter or "statutory underwriter" status or liability on the Subscriber.
