Common use of Underground Services Clause in Contracts

Underground Services. The Underwriters will indemnify the Insured for the Damages and Defence Costs in respect of Personal Injury or (a) prior to the commencement of any work, the Insured enquired of the relevant authority, corporation or company as to the location of such services, cables, pipes or equipment; and (b) the Insured took all reasonable precautions to prevent Personal Injury or Property Damage; and (c) any liability arising out of work carried out more than five metres below ground level is excluded; and (d) any liability arising out of work carried out underground by directional drilling or by a thrusting or boring machine is excluded; and (e) this coverage is subject to the Sublimit of Liability specified in Item 5 of the Schedule. (f) an Excess of $5,000 NZD shall apply unless otherwise specified in Item 5 of the Schedule.
