UNAVOIDABLE OCCURRENCES. If, for any reason, an unforeseen event occurs including, but not limited to fire, casualty, labor strike, terrorist threat/act, war or other unforeseen occurrence, which renders impossible or impractical the fulfillment of any term of this Lease, the Lessee shall have no right to nor claim for damages against Town.
UNAVOIDABLE OCCURRENCES. Contractor shall not be in default of its obligation to furnish the service required under this agreement, or any portion thereof, to the extent it is unable to do because of any concerted refusal of its employees to work or any strike of any kind or character of its or its subcontractors, including a so-called wild-cat strike or slowdown or stoppage; any riot, civil strike or disturbances; closing of streets, roads, routes, or bridges; destruction of any means or methods or any of its property necessary for the performance of this agreement; flood, fire, or any other cause that is beyond Contractor’s control. However, nothing in this section shall be construed as requiring the City to make payment for any services not rendered, or rendered in an untimely manner by Contractor as a result of such causes.
UNAVOIDABLE OCCURRENCES. The Council shall not be held responsible for failure to provide on-time service due to weather or traffic conditions, unavoidable vehicle malfunctions, or naturally occurring disasters. The City shall not be responsible for any loss or damage sustained or claimed to be sustained by the Council or its subcontractors through the failure of the Council or its subcontractors to maintain at all times a timely operating schedule.
UNAVOIDABLE OCCURRENCES. If, for any reason, an unforeseen event occurs including, but not limited to fire, casualty, labor strike, or other unforeseen occurrence, which renders impossible the fulfillment of any term of this agreement, then this agreement may be terminated for cause by either party. Lessor shall refund Lessee all unearned deposits and/or fees.
