Unauthorized Cutting Clause Samples
Unauthorized Cutting. Should Purchaser cut, remove or damage any County owned timber other than as authorized by law, or this contract, Purchaser shall be subject to the provisions of ORS 105.810 to .815.
Unauthorized Cutting. Neenah shall be entitled to seek all remedies available at law for timber trespass if NPNS or its contractors harvest or destroy any Timber that is outside an Actual Designated Tract; however, NPNS shall not be liable for any such damage to the Timberlands caused by anyone other than NPNS or contractors acting on NPNS’s behalf.
Unauthorized Cutting. Purchaser shall be responsible for unauthorized cutting that occurs within the logging unit or during times that Purchaser is unauthorized to cut designated timber. Purchaser agrees to pay triple Current Contract Rates for all material removed and/or damaged from unauthorized cutting.
Unauthorized Cutting. Buyer shall pay Owner as damages an amount equal to 200% of the fair market value of any timber harvested or destroyed by Buyer or its contractors that is outside a Tract designated for harvesting. For this purpose, the fair market value of such timber shall be established based on the Qualifying Timber prices then in effect under Section 3.1.
