Ullage Clause Samples

Ullage. 15.1 Subject to Clause 15.2, the Ullage Policy shall apply to all Product sold by Heineken UK and by KBE pursuant to this Agreement. 15.2 KBE shall be responsible for collating and reporting all ullage claims received from KBE Customers to Heineken UK. Heineken UK will then collect the ullage from the relevant Depots in accordance with the Ullage Policy (for the avoidance of doubt, Heineken UK will not collect ullage out with the United Kingdom), and KBE shall be responsible for applying the credit decision in accordance with the Ullage Policy.

Ullage. The Consignor agrees and acknowledges that: a) unless State Transport and the Consignor agree in writing to the contrary, the acceptable ullage shall be 1.75% of the whole of the goods to which these Terms pertain; and b) State Transport accepts no responsibility for any faults with the goods whatsoever or any shortfalls in the quantity of goods provided to State Transport by sub-contractors and stored and/or delivered by State Transport to the end- user or the Consignor.

Ullage. The Customer acknowledges and agrees that an ullage allowance has been built into the Product Purchase Price and as such, claims under the value of $50 per Order will not be accepted and the Supplier will not be liable for such claims.
