Tuberculosis Certification. Contractor and the Contracted Parties shall at all times comply with the tuberculosis ("TB") certification requirements of Education Code section 49406. Accordingly, by checking the applicable boxes below, Contractor hereby represents and warrants to District the following: ▣ Contracted Parties shall only have limited or no contact (as determined by District) with District students at all times during the Term of this Agreement. □ The following Contracted Parties shall have more than limited contact (as determined by District) with District students during the Term of this Agreement and, at no cost to District, have received a TB test in full compliance with the requirements of Education Code section 49406: Contractor shall maintain on file the certificates showing that the Contracted Parties were examined and found free from active TB. These forms shall be regularly maintained and updated by Contractor and shall be available to District upon request or audit. Contractor further agrees and acknowledges that all new personnel hired after the Effective Date of this Agreement are subject to the TB certification requirements and shall be prohibited from having any contact with District students until the TB certification requirements have been satisfied and District determines whether any such contact is permissible.

Tuberculosis Certification. The Tuberculosis Certification must be completed and attached to this Agreement for any person employed under contract in a certificated or classified position per Education Code Section 49406.
Tuberculosis Certification. (Ed Code 49406) Employee shall be notified by the personnel department that his/her tuberculosis certificate will expire 30 days prior to expiration on file. Notice will be mailed to the employee’s current home address on file with the District and a copy to the supervisor and payroll department. Failure to comply with the required certification will result in the employee being placed on unpaid leave (EC 45304 – Article 14.11.2) status if certificate is not received by the specified date and may also result in disciplinary action and possible termination. Lost wages due to non-compliance will not be reimbursed.

UNIVERSITY shall maintain on file the certificates showing that Intern Teachers and University Mentors were examined and found free from active TB. These forms shall be regularly maintained and updated by UNIVERSITY and shall be available to District upon request or audit. UNIVERSITY further agrees and acknowledges that all new personnel hired after the Effective Date of this Agreement by UNIVERSITY are subject to the TB certification requirements and shall be prohibited from having any contact with District students until the TB certification requirements have been satisfied and District determines whether any contact is permissible.
