Trustee Not Liable for Certificates or Contracts. The recitals contained herein and in the Certificates (other than the authentication of the Certificates) shall be taken as the statements of the Contract Seller or the Servicer, as the case may be, and the Trustee assumes no responsibility for their correctness. The Trustee makes no representations or warranties as to the validity or sufficiency of this Agreement, of the Certificates (except that the Certificates shall be duly and validly authenticated by it) or of any Contract or related document. The Trustee shall not be accountable for the use or application by the Contract Seller or the Servicer of any of the Certificates or of the proceeds of such Certificates, or for the use or application of any funds paid to the Contract Seller or the Servicer in respect of the Contracts or deposited in or withdrawn from the Certificate Account by the Servicer.

The Trustee makes no representations or warranties as to the validity or sufficiency of this Agreement, Agreement (other than as specifically set forth in Section 11.14) or of the Certificates (except that other than the Certificates shall be duly and validly authenticated by itsignature of the Trustee on the Certificates) or of any Contract or related documentdocument or any information provided by the Servicer. The Trustee shall not be accountable for the use or application by the Contract Seller or the Servicer Depositor of any of the Certificates or of the proceeds of such Certificates, or for the use or application of any funds paid to the Contract Seller Depositor or the Servicer in respect of the Contracts or deposited in or withdrawn from the Certificate Account by the Servicer.

The Trustee makes no representations or warranties as to the validity or sufficiency of this Agreement, the Certifi- cates (other than the certificatx xx authentication of the Certificates (except that Certificates), the Certificates shall be duly Sale and validly authenticated by it) Purchase Agreement or of any Contract or related document. The Trustee shall not be accountable for the use or application by the Contract Depositor, the Seller or the Servicer of any of the Certificates or of the proceeds of such Certificatesthereof, or for the use or application of any funds paid to the Contract Depositor, the Seller or the Servicer in respect of the Contracts or deposited in or withdrawn from the Certificate Account by the Depositor, or the Certificate Account or Collection Account by the Seller or the Servicer.
