Common use of Trustee for Warrant Holders Clause in Contracts

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder of the Warrants pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

In the event that a bank or trust company shall have been appointed as trustee for the Holder Holders of the Warrants pursuant to Subsection 3.22.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust --------------------------- company shall have been appointed as trustee for the Holder of the Warrants pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust --------------------------- company shall have been appointed as trustee for the Holder of the Warrants pursuant to Subsection 3.2, such bank or trust company shall shall, to the extent permitted by applicable law, have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust ---------------------------- company shall have been appointed as trustee for the Holder of the Warrants this Warrant pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

In the event that a bank or trust company Company shall have been appointed as trustee for the Holder of the Warrants pursuant to Subsection 3.2Section 4.2, such bank or trust company Company shall have all the powers and duties of a warrant agent (as hereinafter described) appointed pursuant to Section 11 and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants Warrant pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 10.

In the event that a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants this Warrant pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company Parent or such successor person as may be entitled thereto, all amounts otherwise payable to the Company Parent or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or ---------------------------- trust company shall have been appointed as trustee for the Holder holders of the Warrants pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee Trustee for the Holder of the Warrants pursuant to Subsection 3.2Section 2.3, such bank or trust company Trustee shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 11.6.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants pursuant to Subsection 3.2subsection 4.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) appointed pursuant to Section 11 and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder holder of the Warrants this Warrant pursuant to Subsection 3.2subsection 4.2, such each bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) appointed pursuant to section 11 and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have has been appointed as trustee for the Holder of the Warrants this Warrant pursuant to Subsection 3.2Section 3, such bank or trust company shall will have all the powers and duties of a warrant Warrant agent (as hereinafter described) appointed pursuant to Section 10 and shall will accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that If a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants Warrant pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1Section.

In the event that a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants pursuant to Subsection 3.2subsection 5.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) appointed pursuant to Section 13 and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder of the Warrants pursuant to Subsection 3.2Warrants, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.. 1.6

In the event that a bank or trust company shall have been is appointed as trustee for the Holder of the Warrants pursuant to Subsection 3.23(b), such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 12.

Trustee for Warrant Holders. In the event that a bank or trust company --------------------------- shall have been appointed as trustee for the Holder holders of the Warrants this Warrant pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

In the event that a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants Warrant pursuant to Subsection 3.22.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

In the event that a bank or trust company shall have been appointed as trustee for the Holder Holders of the Warrants pursuant to Subsection 3.24.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) appointed pursuant to Section 11 and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

In the event that a bank or ---- --------------------------- trust company shall have been appointed as trustee for the Holder of the Warrants pursuant to Subsection 3.24.2, such bank or trust company shall have all the powers and duties of a warrant Warrant agent (as hereinafter described) appointed pursuant to Section 11 and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder of the Warrants pursuant to Subsection 3.24.2, such bank or trust company shall have all the powers power and duties of a warrant agent (as hereinafter described) and shall duty to accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 12.

Trustee for Warrant Holders. In the event that a bank or trust company shall have has been appointed as trustee for the Holder holder of the Warrants this Warrant pursuant to Subsection Section 3.2, such bank or trust company shall will have all the powers and duties of a warrant agent (as hereinafter described) appointed pursuant to Section II and shall will accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants pursuant to Subsection Section 3.2, such bank or trust company shall have all the powers and duties of a warrant agent Warrant Agent (as hereinafter describeddefined) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust --------------------------- company shall have been appointed as trustee for the Holder holders of the Warrants this Warrant pursuant to Subsection 3.2Section 4.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) appointed pursuant to Section 12 and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 11.4.

Trustee for Warrant Holders. In the event that a bank or trust company ---------------------------- shall have been appointed as trustee for the Holder of the Warrants this Replacement Warrant pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Replacement Warrant pursuant to this Section 11.6.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (appointed as hereinafter described) described below, and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder of the Warrants Warrant pursuant to Subsection 3.2Section 4.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 12.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants Warrant pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant an option agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder of the Warrants pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent Warrant Agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder holders of the Warrants pursuant to Subsection 3.2subsection 4.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) appointed pursuant to Section 13 and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, ,all amounts otherwise payable to the Company or such successor, ,as the case may be, ,on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a qualified bank or trust company shall have been appointed as trustee for the Holder of the Warrants Trustee pursuant to Subsection 3.27.3, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 13.1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have has been appointed as trustee for the Holder holder of the Warrants this Warrant pursuant to Subsection 3.2Section 3, such bank or trust company shall will have all the powers and duties of a warrant agent (as hereinafter described) appointed pursuant to Section 10 and shall will accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1.

Trustee for Warrant Holders. In the event that a bank or trust company shall have been appointed as trustee for the Holder of the Warrants this Warrant pursuant to Subsection 3.2, such bank or trust company shall have all the powers and duties of a warrant agent (as hereinafter described) and shall accept, in its own name for the account of the Company or such successor person as may be entitled thereto, all amounts otherwise payable to the Company or such successor, as the case may be, on exercise of this Warrant pursuant to this Section 1Sections 1 and 2.
