Trustee Commission Clause Samples
Trustee Commission. If a foreclosure proceeding is commenced by the Trustee, Trustee shall be entitled to receive a reasonable and customary commission, but in no event shall such commission exceed an amount that is reasonable in light of the complexity of the matter and the hours expended by the Trustee, and shall become earned in accordance with the following schedule: one-fourth (1/4) thereof as of the date Trustee requests a notice of hearing on the right to foreclosure; one-half (1/2) thereof after the issuance of said notice; three-fourths (3/4) thereof after such hearing; and the full commission after the initial sale. If a foreclosure proceeding is terminated prior to its completion, Trustor shall pay all expenses incurred by the Trustee, including reasonable attorney fees, plus a partial commission computed in accordance with this paragraph.
Trustee Commission. The Trustee shall be entitled to a Trustee’s fee based on the actual number of hours charged by Trustee or its attorneys (such to be based on time actually incurred at its usual hourly rates).
