The 'Trustee as Administrator' clause designates the trustee as the party responsible for managing and administering the trust's assets and affairs. In practice, this means the trustee is empowered to make decisions regarding investments, distributions, and record-keeping on behalf of the trust beneficiaries. By clearly assigning administrative authority, this clause ensures efficient management of the trust and prevents confusion or disputes over who has the legal power to act for the trust.
Trustee as Administrator. The Environmental Response Trust Administrative Trustee shall be the “administrator,” within the meaning of Treasury Regulation Section 1.468B-2(k)(3), of the Environmental Response Trust.

The Environmental Custodial Trust Trustee shall be the “administrator,” within the meaning of Treasury Regulation Section 1.468B-2(k)(3), of the Environmental Custodial Trust. Subject to definitive guidance from the Internal Revenue Service or a judicial decision to the contrary, the Environmental Custodial Trust Trustee shall file tax returns and pay applicable taxes with respect to the Environmental Custodial Trust in a manner consistent with the provisions of Treasury Regulation Section 1.468B-2. All such taxes shall be paid from the Custodial Trust Assets.
