Common use of Trust Monies Not Subordinated Clause in Contracts

Trust Monies Not Subordinated. Notwithstanding anything contained herein to the contrary, payments from money or the proceeds of U.S. Government Obligations held in trust under Article 9 by the Trustee for the payment of principal of and interest on the Notes shall not be subordinated to the prior payment of any Revolver Obligation or subject to the restrictions set forth in this Article 12, and none of the Holders shall be obligated to pay over any such amount to the Issuer or any lender under the Revolver Obligations or any other creditor of the Issuer.

Notwithstanding anything contained herein to the contrary, payments from money or the proceeds of U.S. Government Obligations held in trust under Article 9 8 by the Trustee for the payment of principal of and interest and liquidated damages, if any, on the Notes Securities shall not be subordinated to the prior payment of any Revolver Obligation Senior Indebtedness of either of the Issuers or subject to the restrictions set forth in this Article 1210, and none of the Holders shall be obligated to pay over any such amount to either of the Issuer Issuers or any lender under the Revolver Obligations holder of Senior Indebtedness or any other creditor of either of the IssuerIssuers.
