Common use of Transferor as Holder Clause in Contracts

Transferor as Holder. (a) Except as otherwise provided in Section 3.09(b), in determining whether the Holders of the requisite amount of Certificates have given any request, demand, authorization, direction, notice, consent or waiver hereunder, any Certificate beneficially held by a Transferor, its affiliates or its agents shall be disregarded and deemed not to be outstanding.

Transferor as Holder. (a) Except as otherwise provided in Section 3.09(b3.05(b), in determining whether the Holders of the requisite amount of Certificates have given any request, demand, authorization, direction, notice, consent or waiver hereunder, any Certificate beneficially held by a Transferor, its affiliates or its agents shall be disregarded and deemed not to be outstanding.
