Tort Liability. 40.1 The City shall indemnify and defend employees in the bargaining unit against any tort claim arising out of an alleged act or omission occurring in the performance of duty as required by ORS 30.285 and 30.287 (1977 replacement part). 40.2 Legal Defense Plan: The City will contribute towards the PORAC Legal Defense Plan that provides each employee with an attorney as a direct result of criminal charges or a criminal investigation arising out of the employee’s performance of his/her duties as an employee. a. Effective July 1, 2016, the City will contribute the current contribution for Plan II coverage not to exceed $5.00 per month for each employee, paid by quarterly reimbursement of invoice provided by the Association for the “PORAC” Plan. b.
