Common use of Tombstone Clause in Contracts

Tombstone. The Company and the Trust acknowledge that the Dealer Managers may, with the prior review and approval of the Company, which approval shall not be unreasonably withheld, place an announcement in such newspapers and periodicals as the Dealer Managers may choose, stating that the Dealer Managers are or were acting as dealer manager and financial advisors to the Company and the Trust in connection with the Exchange Offer. The costs relating to any such tombstone shall be borne by the Dealer Managers.
