Common use of Timelines for Performance Clause in Contracts

Timelines for Performance. The Parties will use commercially reasonable efforts to complete their respective obligations under the Project Plan within the timeframes specified in the Project Plan. Each Party will promptly inform the other Party in the event that it anticipates or experiences a delay in the completion of such activities. Each Party shall be responsible for any delay or failure by it (or its Affiliates) to timely complete its obligations under the Project Plan using commercially reasonable efforts, except to the extent that (i) such failure or delay is caused by a delay or failure of performance by the other Party or any Contract Laboratory, or (ii) as may otherwise be mutually agreed in writing by the Parties.
