Common use of Time Extension Permitted if Not Contractor’s Fault Clause in Contracts

Time Extension Permitted if Not Contractor’s Fault. If the time of Design-Builder’s performance is changed due to an Excusable Delay, or due to the fault or negligence of Owner or anyone for whose acts Owner is responsible, Design-Builder shall be entitled to make a request for an equitable adjustment in the Contract Time in accordance with the following procedure. No adjustment in the Contract Time shall be allowed to the extent Design-Builder’s changed time of performance is due to the fault or negligence of Design-Builder, or anyone for whose acts Design-Builder is responsible.
