Common use of Third Party Property Clause in Contracts

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Contract, (B) any Employees, (C) any guests or customers of the Property or (D) the Manager (collectively, the “Excluded Personal Property”);

Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Service Contract, (B) the tenant under any EmployeesTarget Property Lease, (C) any guests or customers property managers of any of the Property or Target Properties, and (D) the Manager (collectivelyground lessor under any Target Ground Lease, in each case, other than to the “Excluded Personal Property”)extent of any Seller Party’s right, title and interest therein;

Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Contract, (B) the tenant under any Space Lease, (C) any Employees, (CD) any guests or customers of the Property any Property, or (DE) the any Manager or Franchisor, but excluding (collectivelyi.e., the “Excluded Personal Property”);following shall be included in Asset-Related Property and transferred to the Buyer at Closing) any rights and/or interests the Sellers may have in the foregoing; and
