Common use of Third Party Property Clause in Contracts

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Contract, (B) the tenant under any Lease or Resident Agreement, (C) any employees, (D) any tenant, guest or customer of any Property, or (E) any Current Manager, but excluding (i.e., the following shall be included in Property and transferred to the Purchaser at Closing) any rights and/or interests the Sellers may have in the foregoing; and

Third Party Property. Any fixtures, personal property, equipment, trademarks property or other intellectual property or other assets which are owned by (Ai) the supplier or vendor lessor under any Contract, Equipment Leases or (Bii) the tenant supplier, vendor, licensor or other party under any Lease Operating Agreements or Resident Agreement, (C) any employees, (D) any tenant, guest or customer of any Property, or (E) any Current Manager, but excluding (i.e., the following shall be included in Property Licenses and transferred to the Purchaser at Closing) any rights and/or interests the Sellers may have in the foregoing; andPermits.

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Contract, (B) the tenant under any Lease or Resident AgreementLease, and (C) any employees, (D) any tenant, guest or customer of any Property, or (E) any Current Manager, but excluding (i.e., the following shall be included in Property and transferred property manager with respect to the Purchaser at Closing) any rights and/or interests the Sellers may have in the foregoing; andProperties;

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are Intellectual Property owned by (Aa) the supplier or vendor lessor under any Contract, Equipment Leases (Bsubject to Purchaser’s rights under the Equipment Leases); (b) the tenant supplier, vendor, licensor or other party under any Operating Agreements, Assumed Property Agreements or Licenses and Permits (including, without limitation, Manager pursuant to the Marriott Lease or Resident Agreement, ); (Cc) any employees, Employee or (Dd) any tenant, guest or customer of any Property, or (E) any Current Manager, but excluding (i.e., the following shall be included in Property and transferred to the Purchaser at Closing) any rights and/or interests the Sellers may have in the foregoing; andResort;

Third Party Property. Any fixtures, personal property, retail merchandise, equipment, artwork, trademarks or other intellectual property or other assets which are owned or leased by (Ax) any guests or customers of the Property, or (y) the supplier or vendor under any Contract, (B) the tenant under any Lease or Resident Agreement, (C) any employees, (D) any tenant, guest or customer of any Property, or (E) any Current Manager, but excluding (i.e., the following shall be included in Property and transferred to the Purchaser at Closing) any rights and/or interests the Sellers may have in the foregoing; and.

Third Party Property. Any fixtures, personal property, equipment, artwork, trademarks or other intellectual property or other assets which are (A) owned or leased by (Ax) the supplier or vendor under any Contract, Contract or (y) Tenants or (B) the tenant under any Lease or Resident Agreement, (C) any employees, (D) any tenant, guest or customer of any Property, or (E) any Current Manager, but excluding (i.e., the following shall be included in Property and transferred to the Purchaser at Closing) any rights and/or interests the Sellers may have in the foregoingleased by Seller; and

Third Party Property. Any fixtures, personal property, equipment, artwork, trademarks or other intellectual property or other assets which are (A) owned or leased by (Ax) the supplier or vendor under any Contract, Contract or (y) Seller’s property manager of the Property or (B) the tenant under any Lease or Resident Agreement, (C) any employees, (D) any tenant, guest or customer of any Property, or (E) any Current Manager, but excluding (i.e., the following shall be included in Property and transferred to the Purchaser at Closing) any rights and/or interests the Sellers may have in the foregoing; andleased by Seller;

Any fixtures, personal property, equipment, trademarks property or other intellectual property or other assets which are owned by (Ai) the supplier or vendor lessor under any ContractEquipment Leases, (Bii) the supplier, vendor, licensor or other party under any Operating Agreements or Licenses and Permits, (iii) the tenant under any Lease or Resident AgreementTenant Leases, (Civ) any employees, (D) any tenant, guest or customer of any PropertyEmployees, or (Ev) any Current Manager, but excluding (i.e., guests or customers of the following shall be included in Property and transferred to the Purchaser at Closing) any rights and/or interests the Sellers may have in the foregoing; andHotels;

Any fixtures, personal property, equipment, trademarks property or other intellectual property or other assets which are owned by (Ai) the supplier or vendor any third party lessor under any ContractEquipment Leases, (Bii) the any third party supplier, vendor, licensor or other party under any Operating Agreements, or Permits, (iii) any third party tenant under any Lease or Resident AgreementLeases, (Civ) any employees, (D) any tenant, guest or customer of any PropertyEmployees, or (Ev) any Current Manager, but excluding (i.e., guests or customers of the following shall be included in Property and transferred to the Purchaser at Closing) any rights and/or interests the Sellers may have in the foregoingHotel; and
