THIRD PARTY HARDWARE AND SOFTWARE. (a) Customer acknowledges that the Software may have been developed by third party software supplier(s) named in the copyright notice(s) included with the Software and agrees that such software suppliers are authorised to hold Customer responsible for any copyright infringement or breach of clause 13 of these Conditions.
THIRD PARTY HARDWARE AND SOFTWARE. In the event that it is reasonably necessary for Healtheon to purchase or license any third-party hardware and/or software in order to perform the Services and/or the Development Work, the Project Managers shall determine whether such third-party hardware and/or software should be purchased and/or licensed by BSC or Healtheon and how the costs and ownership shall be allocated between the parties.
THIRD PARTY HARDWARE AND SOFTWARE. Unless otherwise specified in writing by Adtran, the limited warranties referenced in this Section 7 do not apply to any non-Adtran branded Hardware and Software that may be offered for sale to Customer in the name of a third party. Non-Adtran branded Hardware and Software are warranted solely by the applicable manufacturer or licensor. Adtran will pass through, to the extent permitted, the manufacturer’s and/or licensor’s warranties and Customer shall look solely to such manufacturer or licensor for warranty claims.
THIRD PARTY HARDWARE AND SOFTWARE. Customer recognises that the LC and MC do not include the hardware or the third party software products which may be required to be licensed by Customer for Customer to utilise the various capabilities of the System and that Customer is responsible for the costs and licenses to obtain such hardware or third party software.
THIRD PARTY HARDWARE AND SOFTWARE. Customer shall be responsible for the procurement, installation and maintenance of all required hardware and/or communications equipment not purchased from Xxxxxx. Computers and/or other hardware peripherals supplied by Xxxxxx will be covered by the manufacturer warranties and maintenance policies. No Xxxxxx warranty will be provided on these items. Customer shall be responsible to install and maintain product and security updates for all third party software.
THIRD PARTY HARDWARE AND SOFTWARE. Customer shall be solely responsible for obtaining from Idemia or an Idemia sole expense: (i) all Idemia and third party software that may be required for use in connection with any Updates, major enhancements or new versions; and (ii) all hardware that may be required for the use of any Updates, major enhancements or new versions. Idemia will specify the hardware and third party software requirements for any Updates.
THIRD PARTY HARDWARE AND SOFTWARE. The County shall ensure that its hardware and software currently in use meets the technical requirements set forth in Attachment C, attached hereto and made a part hereof. The County understands that it is the obligation of the County to order, purchase, and install the equipment and software that is compatible with Licensed Software. The Licensed Software cannot be installed or tested until all required equipment is on hand and in complete working order. West Central shall have no liability for late or malfunctioning installations caused by late or nonworking equipment.
THIRD PARTY HARDWARE AND SOFTWARE. Customer shall be solely responsible for obtaining from MorphoTrust or an MorphoTrust authorized or identified vendor, at Customer’s sole expense: (i) all MorphoTrust and third party software that may be required for use in connection with any Updates, major enhancements or new versions; and (ii) all hardware that may be required for the use of any Updates, major enhancements or new versions. MorphoTrust will specify the hardware and third party software requirements for any Updates.
THIRD PARTY HARDWARE AND SOFTWARE. At no cost to TMCS, PARTNER shall acquire all third party hardware and software (including licenses, support or upgrades) required to operate the TMCS System that are not included in the Technology Systems. When feasible and as available, TMCS shall, upon PARTNER's request, assist PARTNER in obtaining and executing license(s) for such hardware or software on more favorable terms than are otherwise available to PARTNER, with no additional cost due to TMCS' involvement.
