Common use of Third Amendment Effective Date Clause in Contracts

Third Amendment Effective Date. This Third Amendment shall become effective upon satisfaction of each of the following conditions: (i) Borrowers, Agent and Lenders shall have executed and delivered to each other this Third Amendment; (ii) Borrower shall have paid to Agent the waiver fee referred to in Section 5 of this Third Amendment. The date on which each of the foregoing conditions precedent is satisfied shall be referred to as the "Third Amendment Effective Date."

Third Amendment Effective Date. This Third Amendment shall become effective upon satisfaction of each of the following conditions: when (i) Borrowers, Agent and Lenders each Lender shall have executed and delivered to each other this Third Amendment; Amendment and (ii) Borrower Borrowers shall have paid to Agent Agent, for the waiver ratable benefit of Lenders, the amendment fee referred to in Section 5 10 of this the Third Amendment. The date on which each of the such foregoing conditions condition precedent is satisfied shall be referred to as the "Third Amendment Effective Date."

This Third Amendment shall become effective upon satisfaction of each of the following conditions: (i) Borrowers, Agent and Lenders shall have executed and delivered to each other this Third Amendment;; and (ii) Borrower Any and all defaults and/or events of default existing under or with respect to the Term Loan Documents, the IRB Indebtedness or the Existing Mortgage Indebtedness shall have paid been cured or waived to Agent the waiver fee referred to in Section 5 of this Third AmendmentAgent’s reasonable satisfaction. The date on which each of the foregoing conditions precedent is satisfied shall be referred to as the "“Third Amendment Effective Date."”
