Common use of The SOFTWARE PRODUCT Clause in Contracts

The SOFTWARE PRODUCT. VERITAS also represents and warrants that it uses reasonable efforts to detect and eliminate code intended to damage, interfere with, or otherwise adversely affect computer programs, data files, or hardware without the consent or intent of the computer user, including without limitation self-replicating and self-propagating programming instructions commonly called viruses and worms, provided that this representation and warranty shall not apply to those Software Products acquired by VERITAS from Seagate pursuant to the Merger Agreement, as set forth in Exhibit F, but further provided that the preceding exclusion shall not apply to modifications or additions in the Software Products made by or for VERITAS.
