THE SETTING OUT Clause Samples

The "Setting Out" clause defines the process by which the physical boundaries and reference points of a construction project are established on site. Typically, this involves the contractor using drawings and specifications provided by the client to mark out the exact locations for structures, utilities, and other key elements before work begins. This clause ensures that all construction activities are based on accurate, agreed-upon measurements, thereby minimizing the risk of errors, disputes, or costly rework due to misplacement or misalignment of works.

The Contractor shall be solely responsible for the true and perfect setting out of the works, and for the correctness of the position, levels, dimensions and alignment of all parts thereof. If at any time any errors shall appear during the progress or on completion of any part of the work, the Contractor shall at his own cost rectify such error if called upon to the satisfaction of the Architect/Consultant. The Bank and/or its representatives shall time to time inspect the work but such inspections shall not exonerate the Contractor in any way from his obligations to remedy any defects, which may be found to exist at any stage of the work or after the same is completed.
