THE PARCEL. (a) In consideration of the mutual promises contained herein, Seller agrees to sell and convey to Buyer, and Buyer agrees to purchase and pay for, upon the provisions, terms, and conditions of this Contract, the Akron Parcel.
THE PARCEL. Lessee acknowledges that Lessee is fully familiar with the Parcel, the physical condition thereof, the Title Matters and all Requirements applicable to the Parcel and any contemplated development thereof. Lessee accepts the Premises in its existing condition and Lessor shall in no event whatsoever be liable for any latent or patent defects in the Premises. In the event the exact acreage is reduced due to minor discrepancies in the legal description of the Parcel or by the Development Plan, no such reduction shall alter or modify any terms or provisions of this Lease including, without limitation, the Rent due and payable hereunder.
