THE LITIGATION. In approximately April 2022, ACTS experienced a cybersecurity attack that potentially exposed the personally identifiable information (“PII”), including but not limited to names, Social Security numbers, and financial account and routing numbers (the “Data Security Incident”), of a number of individuals, including some of its current and former employees.
