THE DEFECTIVE PRODUCT Clause Samples

The 'Defective Product' clause defines what constitutes a product defect under the agreement and outlines the responsibilities of the parties if a product is found to be defective. Typically, this clause specifies the criteria for identifying a defective product, such as failure to meet agreed specifications, safety standards, or performance requirements. It may also detail the process for reporting defects, timelines for notification, and the remedies available, such as repair, replacement, or refund. The core function of this clause is to allocate responsibility for product quality and provide a clear mechanism for addressing issues, thereby protecting both parties from disputes related to defective goods.
