The cheque. The Bank agrees to handle only standardised means of payment. The Bank reserves the right to evaluate the issue of a cheque book to the Client at any time, in relation to his account status, needs, and resources. If the Bank has issued cheque books, it may, on those grounds and at any time, ask the Client to return them by registered letter with advice of receipt. The Bank must justify any refusal to issue a chequebook. Where the Bank has refused to issue a chequebook, it undertakes to review the Client’s position every six months. To that end, the Client may refer the matter to the Bank at any time in writing, and the Bank shall inform the Client in writing of its decision whether or not to issue a cheque book. No reassessment can be made if the Client is subject to a bank or court ban on issuing cheques. If the Client is less than 16 years old, a cheque book will not be issued to him/her. If the Client is at least 16 years old, he/she or his/her legal representatives have the possibility of requesting that a cheque book be issued. If the Client were to be prohibited from issuing cheques, he would be obliged to return to the Bank immediately the blank cheque forms in his possession together with those in the possession of his authorised agent(s). In any event, the issuance of any means of payment, whether or not mentioned hereinabove, requires the Client to comply with all current or future legal, regulatory or contractual provisions that are applicable to him/her and in particular to ensure the existence of available and sufficient funds in the account before issuance. Before issuing any cheque book to the Client, the Bank must consult with the Banque de France. The issuance of cheque books is only authorised for persons not listed in the Central Cheques register kept by the Banque de France identifying persons barred from issuing cheques. The Agreement does not constitute authorisation for the issuance of cheque books, which is subject to approval by the Bank. Cheque books issued by the Bank to the Client shall be pre- crossed and non- transferable; the beneficiaries of such cheques may only transmit them to a credit institution or similar for collection. Cheque books are kept in readiness for the Client at the Bank; they may also be sent to him/her on request at his/her address by recorded delivery, in return for payment of postage costs debited from his/her account.
