The Brussels Draft64. “PARTIES agree to cooperate with each other with a view to eliminating international trade in goods infringing intellectual property rights. For this purpose, they shall establish and notify contact points in their administrations and be ready to exchange information on trade in infringing goods. They shall, in particular, promote the exchange of information and cooperation between customs authorities with regard to trade in counterfeit goods.” As regards Article 69 the main change involves an extension of the types of illicit trade in IPRs that are to be covered by the duty of cooperation and exchange of information introduced by this provision. Thus, while the Anell Draft and the Brussels Draft specified only “trade in counterfeit goods”, the final version refers to trade in “counterfeit trademark goods and pirated copyright goods”.
