Common use of Texas Case Clause in Contracts

Texas Case. Clause 5.1.2 of the Software License Agreement applies mutatis mutandis. If the decision in the Texas Case is in favor of the plaintiff, the parties will use good faith efforts to modify the Project so that the Texas Case does not affect the Project. LLC or any Ownership Party can also suspend this Agreement or terminate this Agreement pursuant to Clause 18.1.
