Tests 37 Clause Samples
The "Tests 37" clause establishes the requirements and procedures for conducting tests on goods, services, or works as specified in a contract. It typically outlines who is responsible for performing the tests, the standards or methods to be used, and the timing or frequency of such tests. For example, it may require the contractor to demonstrate that materials meet certain quality benchmarks before acceptance. The core function of this clause is to ensure that deliverables conform to agreed-upon specifications, thereby protecting the interests of the party receiving the goods or services and reducing the risk of defects or non-compliance.
Tests 37. If the Project Manager instructs the Contractor to carry out a test not specified in the Specification to check whether any work has a Defect and the test shows that it does, the Contractor shall pay for the test and any samples. If there is no Defect, the test shall be a Compensation Event.
