Common use of Testing Contingency Clause in Contracts

Testing Contingency. If the School Site is not suitable for Buyer’s intended use based on the Tests, Buyer in its sole discretion shall have the option either to terminate this Agreement or to waive this Testing Contingency, as provided in Paragraph 6 above. If Buyer elects to terminate this Agreement, in addition to the notice described in Paragraph 6, ▇▇▇▇▇’s written notice shall include a copy of a licensed professional’s determination and copies of any relevant Tests and conclusions that the School Site is unsuitable.
