Tester Expertise. Tester represents and warrants to Company that with respect to any Test Services it provides to Company, (a) Tester has the necessary skill, experience and expertise to render such Test Services; (b) Tester is free from control and direction of Company and Manufacturer in connection with the Test Services; and (c) Tester is customarily engaged in performing services similar to Test Services.
