Common use of Termination of Settlement Clause in Contracts

Termination of Settlement. 2.9 In the event that the Stipulation is not approved, or is terminated, canceled, or fails to become effective for any reason, the Settlement Fund less Notice and Administration Expenses or Taxes or Tax Expenses paid, incurred, or due and owing pursuant to ¶¶2.7 and 2.8 hereof in connection with the Settlement provided for herein, shall be refunded pursuant to written instructions from Defendants’ Counsel in accordance with ¶7.4 herein.

Termination of Settlement. 2.9 2.13 In the event that the Stipulation is not approved, approved or the Stipulation is terminated, canceled, or fails to become effective for any reason, the Settlement Fund (including accrued interest), less Notice and Administration Expenses or Taxes or Tax Expenses paid, incurred, or due and owing pursuant to ¶¶2.7 and 2.8 hereof in connection with the Settlement settlement provided for herein, shall be refunded pursuant to written instructions from Defendants’ Counsel counsel for the Tezos Foundation in accordance with ¶7.4 ¶8.5 herein.
