Common use of Termination of Settlement Clause in Contracts

Termination of Settlement. If the Settlement is terminated as provided in the Stipulation, the Settlement is not approved, or the Effective Date of the Settlement otherwise fails to occur, this Order shall be vacated, rendered null and void, and be of no further force and effect, except as otherwise provided by the Stipulation, and this Order shall be without prejudice to the rights of Lead Plaintiffs, the other Settlement Class Members, and Defendants, and the Parties shall revert to their respective positions in the Action immediately prior to the execution of the Stipulation on May 8, 2023, as provided in the Stipulation.

Termination of Settlement. If the Settlement is terminated as provided in the StipulationStipulation or the Supplemental Agreement, the Settlement is not approved, or the Effective Date of the Settlement otherwise fails to occur, this Order shall be vacated, rendered null and void, and be of no further force and effect, except as otherwise provided by the Stipulation, and this Order shall be without prejudice to the rights of Lead PlaintiffsPlaintiff, the other Settlement Class Members, and Defendants, and the Parties shall revert to their respective positions in the Action immediately prior to the execution as of the Stipulation on May 8November 19, 20232020, as provided in the Stipulation.

Termination of Settlement. If the Settlement is terminated as provided in the Stipulation, the Settlement is not approved, or the Effective Date of the Settlement otherwise fails to occur, this Order shall be vacated, rendered null and void, void and be of no further force and effect, except as otherwise provided by the Stipulation, and this Order shall be without prejudice to the rights of Lead Plaintiffs, the other Settlement Class Members, Members and Defendants, and the Parties shall revert to their respective positions in the Action immediately prior to the execution as of the Stipulation on May 8June 15, 20232019, as provided in the Stipulation.

Termination of Settlement. If the Settlement is terminated as provided in the Stipulation, the Settlement is not approved, or the Effective Date of the Settlement otherwise fails to occur, this Order Judgment shall be vacated, rendered null and void, void and be of no further force and effect, except as otherwise provided by the Stipulation, and this Order Judgment shall be without prejudice to the rights of Lead Plaintiffs, all other Freeport stockholders, Freeport and the other Settlement Class Members, and Settling Defendants, and the Parties shall revert be restored to their respective positions in the Action immediately prior to the execution of the Stipulation on May 8, 2023Term Sheet, as provided in the Stipulation.
