Termination by BBC. BBC may terminate this Agreement for non-performance by providing written notice to MTF, if MTF fails to produce DBM which equal at least seventy-five percent (75%) of the Forecasted Requirements subject to BBC Orders in any two (2) consecutive Term Years except in that instance where the shortfall results from BBC’s failure to order DBM in quantities sufficient to meet the Forecasted Requirements.
