The 'Term; Assignment' clause defines the duration of the agreement and sets the rules for transferring contractual rights or obligations to another party. Term; Assignment. This Agreement shall become effective as of the date of its execution, and:
(a) unless otherwise terminated, this Agreement shall continue in effect until August 16, 2016, and from year to year thereafter so long as such continuance is specifically approved at least annually (i) by the Board of Directors of the Company or by vote of a majority of the outstanding voting securities of the Client, and (ii) by vote of a majority of the Directors of the Company who are not interested persons of the Company, the Adviser or the Sub-Adviser, cast in person at a meeting called for the purpose of voting on such approval;
(b) this Agreement may at any time be terminated on 60 days’ written notice to the Sub-Adviser either by vote of the Board of Directors of the Company or by vote of a majority of the outstanding voting securities of the Client;
(c) this Agreement shall automatically terminate in the event of its assignment or upon the termination of the Adviser’s Investment Advisory Agreement with the Company, on behalf of the Client; and
(d) this Agreement may be terminated by the Sub-Adviser on 60 days’ written notice to the Adviser and the Company, or by the Adviser immediately upon notice to the Sub-Adviser. Termination of this Agreement pursuant to this Section 20 shall be without the payment of any penalty. The Sub-Adviser may not assign this Agreement and this Agreement shall automatically terminate in the event of an “assignment,” as such term is defined in Section 2(a)(4) of the 1940 Act. The Sub-Adviser shall notify the Adviser in writing sufficiently in advance of any proposed change of “control,” as defined in Section 2(a)(9) of the 1940 Act, so as to enable the Company and/or the Adviser to: (a) consider whether an assignment will occur, (b) consider whether to enter into a new Sub-Advisory Agreement with the Sub-Adviser, and (c) prepare, file, and deliver any disclosure document to the Client’s shareholders as may be required by applicable law.
Term; Assignment. 4.4.1 Where a regular Staff Member is appointed for a specified term to a position on Schedule D, the Staff Member shall have the right to return to the Staff Member’s previous position or to an equivalent position at the salary and rank the Staff Member would have had if the Staff Member had continuously occupied that position. Prior to the commencement of the term assignment the Staff Member, the Staff Member’s supervisor, and the appropriate Executive Officer shall reach an understanding regarding the position to which the Staff Member is likely to return.
Term; Assignment. The College will confirm term assignments (if any) for employees on the Part- Time Employee List, if possible, by no later than the sixth week of the prior term. The parties acknowledge that the cooperation of employees is required in order to make such a confirmation.
Term; Assignment. (a) For the purposes of this Article, term assignment shall mean when an existing full time employee either applies for or is appointed to a term assignment.
(b) If the term assignment is expected to last twelve (12) months or more:
(i) the Employer may use the Acting Pay provision, or if not;
(ii) the Employer will post and fill in accordance with Article 13 of the Collective Agreement;
(iii) if filled by an existing seniority employee, such employee shall be eligible to return to his/her former position at the expiry of the term of the assignment;
(iv) if there are no qualified bargaining unit applicants, then the position can be filled with a temporary employee.
(c) If the term assignment is expected to last less than twelve (12) months, the Employer shall first attempt to use the Acting Pay provision if the requirement is above the entrance level and an employee capable of performing the work is available. If such is not the case, the position may be filled with a temporary employee.
(d) If a term assignment which is expected to last less than twelve (12) months exceeds the twelve (12) months and has not been filled on an Acting basis, a meeting/discussion shall take place between the Human Resources Department, the hiring department and the Union to determine whether or not the opening should now be posted.
Term; Assignment. When an employee accepts a term position in the same department as currently employed, and the term assignment ends, the employee shall be reinstated to the same classification as was held prior to the term assignment. In this event, the time spent in the term position shall count toward seniority and the probation period of the employee’s prior position where the required probationary period was not completed prior to movement to the term position.
Term; Assignment a) If a suitable volunteer for a Term Assignment is not found Management may Draft appropriately qualified individuals to carry out the assignment. Drafted Members shall not be required to remain on a Term Assignment for longer than twenty-eight (28) Days, nor will Term Assignments be assigned back to back; i.e. Any one Member will only be Drafted a maximum of 3 Term Assignments in any given calendar year.
b) Where Management Drafts a Member for a Term Assignment, the Member shall be reimbursed by the Company for the non-refundable portion of contracts or reservations made by the Member in respect of that period, subject to the presentation of any documentation management may require. The Member must make every reasonable effort to mitigate any losses incurred and will provide proof of such action to management when requested. In this case, or other extenuating circumstances, the Vice President Maintenance and Engineering or his designate, has discretion to bypass the Member and Draft the next Member down the Draft list.
c) If fourteen (14) Days or less notice is provided for the purpose of Drafting a Member to a Term Assignment, the Member may elect to restrict the duration of that Term Assignment to not exceed fourteen (14) Days in duration. The Member must inform Management of this intent at the time of Drafting.
d) Once Drafted for a Term Assignment, the Member moves to the bottom of the Draft list.
e) Where a suitable volunteer has been found, that Member shall be moved to the bottom of the Draft list.
Term; Assignment. (a) If the Licensee validly renews the Term, then the Licence shall be deemed to have been renewed or extended for a further period coinciding with the Further Term.
(b) It is a condition of the Licence that the Lease shall not be determined and shall not be assigned without the contemporaneous assignment of the Licence and that the Licence of the Car Bays shall not be assigned without the contemporaneous assignment of this Lease and that on the happening of any such events the Licence shall be forthwith determinable by notice in writing to the Licensee.

Unico shall hold the Leased Premises for the purpose of mining all kinds of minerals and ores for a period of two (2) years from the date of this Revised Lease Agreement (the "Effective Date" ), unless the Revised Lease Agreement is sooner terminated under any provision contained herein. Each party, with the prior written consent of the other, which consent shall not be unreasonably withheld, shall have the power to assign or sublet this Revised Lease Agreement or any interest hereunder. Notwithstanding the Effective Date, Unico shall have reasonable access to the Leased Premises prior to the Effective Date to prepare work plans and complete preliminary preparations.

Upon receipt of a written request for a position evaluation review a Human Resources Officer shall call a meeting of the Position Evaluation Committee within working days, and notify the requester and incumbent (if any) in writing of the Committee's decision within working days. Results of a position review may be appealed according to the Appeal procedure (Section 9.6). In the event that the Position Evaluation Committee reviews the evaluation of a position and determines that the position should be revised upwards to a higher salary range, the new evaluation and salary range will take effect at the beginning of the next month and will apply to the incumbent in the position. In this case, the Staff Member's salary will be automatically increased to the minimum salary of the revised salary range. Where the Staff Member's salary in additional increment will be applied. Any increase shall be handled in accordance with the provisions of clause In the event that the Position Evaluation Committee reviews the evaluation of a position and determines that the position should be placed in a lower salary range, the incumbent's salary shall be adjusted in accordance with clauses and or the present salary of the incumbent who has requested position review be within the salary range for the position, the salary may still be raised in accordance with the provisions of clauses The Council shall establish each position to which the provisions of this Agreement apply, and shall specify the kind of appointment that may be made and the classification or rank approved for position. Availability of professional positions will be publicly advertised both internally and externally. Applications for appointment to a continuing position shall be considered by a Search Committee. Term; Assignment. The term of the Transmission Easement shall expire upon expiration or termination of this Agreement. Grantee (and any Assignee) shall have the right, without need for Owner’s consent, to assign or convey all or any portion of the Transmission Easement to an Assignee on an exclusive or nonexclusive basis. The Transmission Easement shall run with the Property and inure to the benefit of and be binding upon Owner and Grantee and their respective transferees, successors and assigns, and all persons claiming under them. (Comment: The Transmission Easement that is authorized in the Easement will remain binding upon the Property of Owner after termination of the Easement. The Transmission Easement will continue to affect Owner’s Property and may significantly reduce the properties fair market value at a time when the Owner does not have income from wind turbines.)
