Common use of Tenant’s Application Clause in Contracts

Tenant’s Application. If Tenant desires at any time to assign or otherwise transfer this Lease (which transfer shall in no event be for less than Tenant's entire interest in this Lease) or to sublet the Premises or any portion thereof, Tenant shall submit to Landlord at least sixty (60) days prior to the proposed effective date of the transfer or sublease ("Proposed Effective Date"), in writing: (a) a notice of intent to transfer or sublease, setting forth the Proposed Effective Date, which shall be not less than sixty (60) nor more than ninety (90) days after the sending of such notice; (b) the name of the proposed subtenant or transferee; (c) the nature of the proposed subtenant's or transferee's business to be carried on in the Premises; (d) the terms and provisions of the proposed sublease or transfer; (e) such certified financial information as Landlord may request concerning the proposed subtenant or transferee, including recent financial statements and bank references and (f) evidence satisfactory to Landlord that the proposed subtenant or transferee will immediately occupy and thereafter use the affected portion of the Premises for the entire term of the sublease or transfer agreement.

Tenant’s Application. If Tenant desires at any time to assign or otherwise transfer this Lease (which transfer assignment shall in no event be for less than Tenant's its entire interest in this Lease) or to sublet more than ten percent (10%) of the Premises or any portion thereofPremises, Tenant shall submit to Landlord at least sixty forty-five (6045) days prior to the proposed effective date of the transfer or sublease transaction ("Proposed Effective Date"), in writing: (a) , a notice of intent to transfer assign or sublease, setting forth forth: (i) the Proposed Effective Date, which shall be not no less than sixty forty-five (6045) nor more than ninety (90) days after the sending of such notice; (bii) the name of the proposed subtenant or transfereeassignee; (ciii) the nature of the proposed subtenant's or transfereeassignee's business to be carried on in the Premises; and (div) a description of the terms and provisions of the proposed sublease or transfer; assignment. Such notice shall be accompanied by (ei) such certified financial information as Landlord may request concerning the proposed subtenant or transfereeassignee, including recent financial statements and bank references and references; (fii) evidence satisfactory to Landlord that the proposed subtenant or transferee assignee will immediately occupy and thereafter use the affected portion of the Premises for the entire term of the sublease or transfer assignment agreement; (iii) a conformed or photostatic copy of the proposed sublease or assignment agreement; and (iv) any fee required under Section 28.
